Terms of Service

Important: These terms constitute a legally binding agreement between you and alllowercase, llc. By using Friends of Friends, you agree to these terms. Please read them carefully.

1. Acceptance of Terms

Welcome to Friends of Friends ("FoF", "the app", "our service"). These Terms of Service ("Terms") govern your access to and use of the FoF mobile application, operated by alllowercase, llc ("we", "us", "our").

By creating an account, accessing, or using FoF, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use FoF.

2. Eligibility

You must meet the following requirements to use FoF:

• You must be at least 13 years of age
• You must have the legal capacity to enter into a binding contract
• You must not be prohibited from using our service under applicable laws
• You must provide accurate and truthful information during registration

By using FoF, you represent and warrant that you meet these eligibility requirements.

3. Account Registration and Security

3.1 Account Creation

To use FoF, you must create an account by providing:

• Your display name (name to show on your profile)
• A valid email address
• A valid phone number
• A secure password

You agree that all information you provide is accurate, current, and complete. You must update this information as necessary to maintain its accuracy.

3.2 Phone Number Verification

Your phone number must be verified via SMS verification code. You are responsible for any charges your mobile carrier may apply for SMS messages. One account is permitted per verified phone number.

3.3 Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring that you log out from your account at the end of each session

We are not liable for any loss or damage arising from your failure to protect your account credentials.

4. User Responsibilities

4.1 Acceptable Use

You agree to use FoF only for lawful purposes. You will not:

• Violate any local, state, national, or international law
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
• Use FoF to harass, abuse, stalk, threaten, defame, or otherwise violate the legal rights of others
• Upload or transmit viruses, malware, or other malicious code
• Attempt to gain unauthorized access to FoF, other accounts, or computer systems
• Interfere with or disrupt the service or servers connected to the service
• Use automated systems (bots, scripts, scrapers) to access or interact with FoF without our written permission
• Collect or harvest personal information about other users
• Reverse engineer, decompile, or disassemble any aspect of FoF
• Use FoF for any commercial purpose without our express written consent

4.2 Content Standards

You are solely responsible for the content you post on FoF. You agree not to post content that:

• Is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable
• Infringes any patent, trademark, trade secret, copyright, or other proprietary rights
• Contains unsolicited or unauthorized advertising, promotional materials, spam, or any other form of solicitation
• Contains private information about any third party without their consent
• Contains software viruses or any other harmful code
• Depicts or promotes violence, self-harm, or dangerous activities
• Sexually exploits or endangers minors in any way
• Promotes illegal drugs, weapons, or other illegal activities

4.3 Reporting Violations

If you encounter content or behavior that violates these Terms, you can report it through the app's reporting feature or by contacting jacob@alllowercase.co. We review all reports and take appropriate action, which may include content removal or account suspension.

5. Content and Intellectual Property

5.1 Your Content

You retain all ownership rights to the content you post on FoF ("Your Content"). By posting content, you grant us a worldwide, non-exclusive, royalty-free license to:

• Use, reproduce, modify, adapt, and display Your Content
• Distribute Your Content through the FoF service
• Store Your Content on our servers

This license exists only for the purpose of operating, promoting, and improving FoF. It ends when you delete Your Content or your account, except where Your Content has been shared with others and they have not deleted it.

5.2 Content Visibility

You control the visibility of your posts through visibility settings:

• My Friends (1 degree): Only your direct contacts can see
• Friends of Friends (2 degrees): Your contacts and their contacts can see
• Extended Network (3 degrees): Connections up to 3 degrees can see
• Anyone (6 degrees): All FoF users can see (public)

You are responsible for setting appropriate visibility levels for your content.

5.3 Reposting

You control whether others can repost your content. You can:

• Allow or disallow reposting on a per-post basis
• Block specific users from reposting specific posts

When you allow reposting, other users may share your content with their connections, subject to their visibility settings.

5.4 Our Intellectual Property

FoF and its original content, features, and functionality are owned by alllowercase, llc and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not:

• Copy, modify, or create derivative works of FoF
• Use our trademarks, logos, or branding without written permission
• Remove or alter any copyright, trademark, or other proprietary notices

6. Contact Access and Privacy

FoF's core functionality involves building a social graph based on your contacts. When you grant contact access:

• We extract phone numbers from your device contacts
• We convert each phone number into a secure hash before uploading
• We never upload contact names or store plain text phone numbers
• We match hashed phone numbers to build your connection graph

You can revoke contact access at any time through iOS Settings. See our Privacy Policy for complete details on how we handle your information.

7. Messaging and Communication

FoF enables you to message other users within your network:

• You can send messages to 1st and 2nd degree connections
• Initial messages may require acceptance by the recipient (message requests)
• Messages are private between sender and receiver
• You are responsible for the content of your messages
• We may review messages in response to reports of abuse or violations

8. Modifications to the Service

We reserve the right to:

• Modify, suspend, or discontinue FoF (or any part thereof) at any time with or without notice
• Change or impose fees for use of FoF (currently free) with reasonable advance notice
• Update features, add new features, or remove existing features

We are not liable to you or any third party for any modification, suspension, or discontinuance of FoF.

9. Account Termination

9.1 Termination by You

You may terminate your account at any time through app settings or by contacting jacob@alllowercase.co. Upon termination:

• Your profile and content will be removed from FoF
• Your connections will be severed
• Your access to FoF will be immediately revoked

9.2 Termination by Us

We reserve the right to suspend or terminate your account and access to FoF, without notice, for:

• Violation of these Terms
• Fraudulent, harmful, or illegal activity
• Extended periods of inactivity
• Any reason at our sole discretion

We may also remove any content that violates these Terms or is otherwise objectionable.

9.3 Effect of Termination

Upon termination:

• All licenses granted by you to us will terminate
• We may delete your data in accordance with our Privacy Policy
• Sections of these Terms that by their nature should survive termination will survive (including ownership provisions, warranty disclaimers, and limitations of liability)

10. Disclaimers and Limitations of Liability

10.1 "As Is" Service

FoF IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• FoF will be uninterrupted, secure, or error-free
• Defects will be corrected
• FoF or our servers are free of viruses or harmful components
• Results from using FoF will meet your requirements

10.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ALLLOWERCASE, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use FoF
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from FoF
• Any bugs, viruses, trojan horses, or the like transmitted through FoF by any third party
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through FoF
• User content or the defamatory, offensive, or illegal conduct of any third party

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED ONE HUNDRED DOLLARS ($100).

10.3 Third-Party Services

FoF may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

11. Indemnification

You agree to indemnify, defend, and hold harmless alllowercase, llc, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of FoF
• Your violation of these Terms
• Your violation of any third-party right, including any intellectual property or privacy right
• Any content you post on FoF

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

12.2 Arbitration

Any dispute arising from or relating to these Terms or your use of FoF shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in New York, and judgment on the arbitration award may be entered in any court having jurisdiction.

Exception: You may assert claims in small claims court if your claims qualify and remain in small claims court.

12.3 Class Action Waiver

YOU AND ALLLOWERCASE, LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

13. General Provisions

13.1 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by:

• Posting the new Terms on this page
• Updating the "Last Updated" date
• Sending you a notification through the app for material changes

Your continued use of FoF after changes constitutes acceptance of the modified Terms.

13.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and alllowercase, llc regarding FoF and supersede all prior agreements.

13.3 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

13.4 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13.5 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

13.6 Export Control

You agree to comply with all applicable export and re-export control laws and regulations in your use of FoF.
